Terms of Service

These Terms of Service ("Terms") govern your use of Finn, a transactional email API and SMTP relay operated at https://finn.computer. By creating an account or sending email through Finn, you agree to these Terms.
1. Service
Finn provides a programmatic interface for sending transactional email and newsletters. We accept email you submit, apply moderation and anti-abuse rules, and deliver it via AWS Simple Email Service.
You agree to our Acceptable Use Policy. Failure to comply may result in suspension or termination of your account.
2. Your account
You must provide accurate information at signup and keep it current. You are responsible for all activity under your account and for the security of your API keys and SMTP credentials. Keys are shown once at creation and cannot be retrieved; if you lose one, rotate it.
You warrant that you are at least 18 years old and authorised to enter these Terms, either on your own behalf or on behalf of the entity you represent.
3. Your content
You retain ownership of the email content you submit. You grant Finn a non-exclusive, worldwide licence to process and transmit that content solely to deliver it via the service and to apply moderation and deliverability controls.
You represent that you have the legal right to send every message you submit and that recipients have consented to receive mail from you where consent is required by applicable law.
4. Prohibited use
You must not use Finn to send unsolicited bulk email, phishing, malware, fraud, or content that violates applicable law. Full rules are in the Acceptable Use Policy. We may suspend or terminate your account for violations at our discretion.
5. Pricing and payment
Paid plans are billed via Paddle, our Merchant of Record. Paddle handles taxes, invoicing, chargebacks, and subscription management. Your agreement with Paddle governs payment-specific terms.
Free-tier accounts have monthly send quotas. Exceeding the quota stops sends until the quota resets or you upgrade.
If a payment fails, we suspend sending after a 14-day grace period. Suspension does not delete your data; you can settle the balance to reactivate, or cancel to delete.
6. Service availability
We aim for 99.9% uptime but do not guarantee it. Scheduled maintenance, dependency outages (AWS, Fly.io, Cloudflare, Paddle), and force majeure events may cause unavailability. Service credits are not provided on the free tier. Paid tiers may include SLA terms in plan descriptions.
7. Termination
Either party may terminate for convenience with 30 days' written notice. We may terminate immediately for cause, including any violation of the Acceptable Use Policy, non-payment, or actions that threaten other customers or the platform.
On termination:
- You lose the ability to send via Finn.
- Your data is retained for 90 days (see Privacy Policy) and then deleted.
- Sections of these Terms that by their nature survive termination will survive (payments owed, disclaimers, limitations, indemnities).
8. Disclaimer
Finn is provided "as is" and "as available". We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
9. Liability
To the maximum extent permitted by law, Finn's aggregate liability for any claim under these Terms is capped at the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater. We are not liable for indirect, consequential, or special damages (including loss of profits, revenue, data, or business).
10. Indemnification
You agree to indemnify Finn against any third-party claims, damages, or costs (including reasonable legal fees) arising from your use of the service, your email content, or your violation of these Terms or of applicable law.
11. Changes
We may update these Terms from time to time. Material changes will be announced to account owners by email at least 14 days before the effective date. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of Ireland. Disputes will be resolved in the courts of Ireland, except where applicable consumer-protection law grants you rights in another jurisdiction.
